In this book, the author has attempted to combine an examination of legal customs of the Sinhalese with a statement of the Kandyan Law as it was administered in earlier part of the twentieth century in Sri Lankan courts. The author has included in the book some account of a body of law, which from its antiquity, may be of interest to students of sociology and jurisprudence; where portions of it have fallen into dis- use, or were abolished, the author has indication the nature of rules substituted. According to the author, the Kandyan Law has labored under considerable disadvantages in modern times; the officials who administered the inland districts during the early days of the British occupation have left valuable collections of files; living amongst the Kandyans, they themselves appear to have assimilated, to a remarkable extent, the spirit of the laws which they were called upon to explore. The author has attempted to formulate general principles from the mass of conflicting opinions, which then existed.
As the Kandyan law is the surviving portion of what was at one time the common law of the island, the author endeavoured to restrict the term ‘Kandyan law’ to those branches which still have force in the Kandyan districts, while applying the wider term ‘Sinhalese law’ when discussing general principles or obsolete subjects.
Although the book purports to deal only with law, certain social customs an understanding of which is necessary for the proper appreciation of law, the author has inserted, by way of introduction, a brief outline of the history of the island and a few remarks concerning its people.
